Rule Change – 61J2-3.020 – Post License Education

The 30 day wait period to retake your end of course exam has been removed effective March 25, 2018. You will now be able to retake the end of course exam immediately but it cannot be the same exam and you are limited to one retake per course.

Announcement – Please be aware that we have finalized a NEW mutual recognition agreement with the regulatory agency for the State of Rhode Island, effective March 19, 2018.  When applying for a Florida Real Estate license, you may apply your education and experience to qualify under this new mutual recognition agreement. 

Announcement – Real Estate Paperless Licensing Started June 4, 2015

The Department of Business and Professional Regulation and the Florida Real Estate Commission are excited to announce an advancement in how we license real estate professionals in the State of Florida.

The Department has implemented an innovative way to expedite the licensing process for real estate professionals. Applicants who have passed the state’s licensing examination can now print their licenses by just logging into their secure online account with the Department at www.myfloridalicense.com. This will allow new licensees to enter the work force at least 7 to 10 business days early, whereas, in the past, they would have to wait for the license to arrive in the mail. The Department regulates over one million license holders and on an average issues 2000 real estate licenses each month. In addition to new licenses, this process will allow licensees to renew online and print the license at their convenience.

Alert – FREE Online Certifications

The Division of Real Estate is proud to announce we have upgraded our FREE online license certifications to ensure they are accepted by the other states and jurisdictions for licensure. Just log on to your online account and click the license you wish to have the certification completed for and the menu will have a selection for “FREE Certification of Licensure”.

We have up to 21 jurisdictions, you may select, that upon hitting submit will get the certification sent to them directly on your behalf; you will also receive an email with the same documents for your records. For all others, you must print in color or electronically send the document to the jurisdiction in which you are wishing to obtain a license; if the document is not in color it will not be considered a certified original certification.

Permissible Activities of an Unlicensed Assistant
The Florida Real Estate Commission (THE FLORIDA REAL ESTATE COMMISSION (FREC) ) has recently revised and approved new guidelines

Permissible Activities of an Unlicensed Assistant Unlicensed assistant is defined as support staff for a real estate corporation or other licensed individuals.

  • • Answer the phone and forward calls
  • • Fill out and submit listings and changes to any multiple listing service
  • • Follow-up on loan commitments after a contract has been negotiated and generally secure the status reports on the loan progress
  • • Assemble documents for closing
  • • Secure documents (public information) from courthouse, utility district, etc.
  • • Have keys made for company listings, order surveys, termite inspections, home inspections and home warranties with the licensed employer’s approval
  • • Write ads for approval of the licensee and the supervising broker, and place advertising (newspaper ads, update web sites, etc); prepare flyers and promotional information for approval by licensee and the supervising broker
  • • Receive, record and deposit earnest money, security deposits and advance rents
  • • Only type the contract forms for approval by licensee and supervising broker
  • • Monitor licenses and personnel files
  • • Compute commission checks
  • • Place signs on property
  • • Order items of repair as directed by licensee
  • • Prepare flyers and promotional information for approval by licensee and supervising broker
  • • Act as a courier service to deliver documents, pick-up keys
  • • Place routine telephone calls on late rent payments
  • • Schedule appointments for licensee to show a listed property Be at an open house for:
    • o Security purposes
    • o Hand out materials (brochures)
  • • Answer questions concerning a listing from which the answer must be obtained from the licensed employer-approved printed information and is objective in nature (not subjective comments)
  • • Gather information for a Comparative Market Analysis
  • • Gather information for an appraisal
  • • Hand out objective, written information on a listing or rental
