Per s. 475.01(1)(a) “Sales associate” means a person who
performs any act specified in the definition of “broker,” but who performs such
act under the direction, control, or management of another person. A sales
associate renders a professional service and is a professional within the
meaning of 95.11(4)(a).
Some states refer to a “Sales Associate License” as a “Brokers License” In Florida A “Brokers License” describes a
different type of real estate license. A
sales associate must work under a Florida Broker, Government Agency, Owner or
Owner Developer. Today there are plenty
of brokerage offices that offer a wide range of services to support sales
associates however some offer 100% commissions with no percentage splits
between the broker and the sales associate.
A Florida real estate school licensed in Florida pursuant to Section 475.451, F.S., and who, while attending a real estate school, satisfactorily completed real estate courses covering substantially the same subject matter, classroom hours of attendance, and completion standards as prescribed by the Commission in Rule 61J2-3.008, F.A.C., shall be deemed to have satisfactorily completed the course.
Any persons desiring to become licensed as a real estate sales associate must satisfactorily complete the Commission-prescribed course designated as Course I. This course will consist of 63 hours of 50 minutes each, inclusive of examination, in the basic fundamentals of real estate principles and practices, basic real estate, and license law. This rule sets forth the course approval criteria and procedure.
The applicant must complete a 63 Hour Pre-license course known as THE FLORIDA REAL ESTATE COMMISSION (FREC) I to become a licensed Florida Real Estate Sales Associate. The course may be done in a classroom or through distant education known as online courses. Both courses will have an end of course exam containing 100 multiple choice questions. The student must receive a 70% or greater to have successfully passed THE FLORIDA REAL ESTATE COMMISSION (FREC) I course. If the student fails their first attempt at the end of course exam. A second attempt will be provided by the school after waiting 30 days but no more than one year to pass a different version of the exam containing 100 multiple choice questions. The student must receive a grade of 70% of greater. Students failing both end of course exams will be required to re-enroll and take the course again from the same or different licensed real estate school.
After completing the 63-hour pre-license course, the student will have met the educational prerequisite to sit for the Florida Sales Associate Real Estate State Exam.
