Only an active licensed real estate broker may open an office to operate a brokerage company providing the services of real estate to another for compensation.

475.15 – Registration and licensing of general partners, members, officers, and directors of a firm.—Each partnership, limited liability partnership, limited liability company, or corporation which acts as a broker shall register with the commission and shall renew the licenses or registrations of its members, officers, and directors for each license period. However, if the partnership is a limited partnership, only the general partners must be licensed brokers or brokerage corporations registered pursuant to this part. If the license or registration of at least one active broker member is not in force, the registration of a corporation, limited liability company, limited liability partnership, or partnership is canceled automatically during that period of time. The commission shall adopt rules that allow a brokerage to register a broker on a temporary, emergency basis if a sole broker of a brokerage dies or is unexpectedly unable to remain a broker.

The applicant must complete a 72 Hour Pre-license course known as THE FLORIDA REAL ESTATE COMMISSION (FREC)  II to become a licensed Florida Real Estate Broker.  The course may be done in a classroom or through distant education known as online courses.  Both courses will have an end of course exam containing 95 multiple choice questions. (The last 5 questions are worth 2 points each and are related to the closing statement) The student must receive a 70% or greater to have successfully passed the THE FLORIDA REAL ESTATE COMMISSION (FREC)  II course.  If the student fails their first attempt at the end of course exam. A second attempt will be provided by the school after waiting 30 days but no more than one year to pass a different version of the exam containing 95 multiple choice questions. (The last 5 questions are worth 2 points each and are related to the closing statement)The student must receive a grade of 70% of greater.  Students failing both end of course exams will be required to re-enroll and take the course again from the same or different licensed real estate school. 

After completing the 72-hour pre-license THE FLORIDA REAL ESTATE COMMISSION (FREC)  II course, the student will have met the educational prerequisite to sit for the Florida Brokers Real Estate State Exam.
